Loan Factory (“us,” “we,” or “our”) is committed to making your experience convenient and transparent. We respect your privacy and comply with the Telephone Consumer Protection Act (TCPA) and all other applicable communication laws.

This policy explains how and when we may contact you, and how you can manage or withdraw your consent.

1. When You Provide Consent

By providing your phone number or otherwise contacting Loan Factory, you give us consent to communicate with you regarding:

  • Your loan inquiry or application status;
  • Requests for additional documentation or information;
  • Scheduling appointments or providing updates; and
  • General account or transaction notifications.

2. Phone calls

We may contact you by phone. Calls may be made manually by one of our representatives, or—when permitted by law—using an automatic telephone dialing system (autodialer) or prerecorded message.

We comply with the National Do Not Call Registry and our internal Do Not Call policy. If your number is listed on the DNC Registry, or if you ask us not to call you, we will not contact you by phone for marketing or promotional purposes.

3. Text Messages (SMS)

We may send text/SMS messages regarding your mortgage inquiry, application, or transaction-related communications.

Message frequency may vary depending on your loan stage or service needs, up to ten (5) SMS messages per week related to your transaction.

Message and data rates may apply depending on your carrier and plan. Fees may vary if the message is sent domestically or internationally.

SMS consent is not required to use our services.

Loan Factory is not responsible for delayed or undelivered messages caused by your wireless service provider.

4. Revoking Consent and Opting Out

Consent is not a condition of applying for or obtaining a loan or other service.

You may revoke your consent or opt out at any time by:

  • Replying STOP to any text/SMS message you receive from us (this will stop text messages only and will not affect phone calls or other forms of communication). You will receive one final confirmation message before you stop receiving future texts.
  • Following the opt-out instructions provided in our communications; or
  • Contacting us directly at (660) 333-3333 to request that we stop phone calls, text/SMS messages, or all communications.

You confirm that you are the authorized user of the phone number you provide and agree to notify us if your number changes or is reassigned. You agree to hold us harmless from any claims resulting from your failure to update your contact information.

Governing Law: This policy is governed by the laws of the State of California. All disputes must be resolved exclusively in the state or federal courts located in Santa Clara, California.

Reservation of Rights: All content in our emails, calls, and text messages is proprietary. Reproduction or distribution requires our prior written consent.
